Update on Workers Compensation Act 2008 – Tanzania

We are advised by WCF, on verbal enquiry, that the fund will be operational effective from 01/07/2016. Accordingly, the insurance that currently covers employees for the statutory liability will be redundant.

However, the Act does not affect the Common Law liability and employers will remain liable and exposed to the risk of being sued for any occupational injury or illness caused by employer’s negligence at work.

In brief, the Act presents the following implications and challenges:

  1. The statutory liability insurance will be redundant
  2. Employers will be exposed to the risk of litigation if an employee decides to claim through a court process
  3. The Common Law Liability will be unlimited.
  4. The Fund has a right to recover any settlement of claims from employer found to have caused the injury or illness due to negligence.
